Challenge
OGR represents utilities who have been penalized for exceeding their air permits while running under DOE emergency orders, exposing the companies to lawsuits and financial penalties.
Strategy
OGR identified Congressional champions and developed legislation to provide clarification under the Federal Power Act that would protect electricity generators when they are operating under a federal directive.
Results
On March 28, 2012, a bipartisan group of Congressmen introduced a bill in the U.S House of Representatives to address the problem. On July 26, 2012, the House of Representatives passed The Grid Reliability Act by voice vote.
